01 Acceptance of Terms

By accessing or using NutriFell (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including unregistered visitors, registered members, and subscribers.

We reserve the right to update these Terms at any time. We will notify registered users by email for material changes. Continued use after the effective date of changes constitutes acceptance.

02 Description of Service

NutriFell is a nutrition tracking and meal planning application that provides:

• An interactive 3D food explorer with nutritional data for 74 whole foods
• A personalised calorie and macro calculator based on the Mifflin-St Jeor formula
• A virtual fridge and AI-generated meal plans
• Daily food, calorie, and water intake logging
• A quit-smoking tracker with progress milestones
• Community recipe sharing and a social feed
• NutriAI — an AI nutrition chat powered by Google Gemini

NutriFell is currently offered as a free beta. Features may change, be added, or be removed at our discretion. We do not guarantee uninterrupted availability.

03 User Accounts

• Age requirement: You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.
• Accurate information: You agree to provide accurate, current, and complete information during registration and to keep it up to date.
• One account per person: Each person may maintain only one account. Creating multiple accounts to circumvent bans or limits is prohibited.
• Account security: You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorised access.
• Email verification: A verified email address is required to complete registration. We use it for authentication and service communications only.

04 Acceptable Use

You agree not to:

• Post spam, unsolicited promotional messages, or repetitive content
• Harass, threaten, or abuse other users
• Post false, misleading, or dangerous health claims
• Upload copyrighted content (photos, videos) without permission from the rights holder
• Attempt to gain unauthorised access to other users' accounts or our server
• Use automated bots or scrapers to access the Service
• Engage in any illegal activity through the platform
• Upload malware, viruses, or any code designed to harm users or the Service
• Impersonate any person or entity

Violation of these rules may result in immediate account termination without notice.

05 User Content

Ownership: You retain ownership of the content you post to NutriFell — including photos, videos, recipes, and posts ("User Content").

License to us: By posting User Content, you grant NutriFell a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content within the Service for as long as it is posted. This license is solely for operating and improving NutriFell; we will not sell your content to third parties.

Content you are responsible for: You represent that you have the right to post any content you upload, that it does not infringe any third-party rights, and that it complies with these Terms.

Removal: We reserve the right to remove any User Content that violates these Terms or that we determine, at our sole discretion, to be harmful or inappropriate. We will make reasonable efforts to notify you, except where immediate removal is required to protect users or comply with law.

06 Health & Medical Disclaimer

• Always consult a qualified healthcare professional before starting any new diet, making significant changes to your eating habits, or if you have a pre-existing medical condition.
• Calorie targets generated by NutriFell are estimates based on published formulas. Individual metabolism, medical history, and other factors can significantly affect actual needs.
• AI-generated responses (NutriAI) are general guidance only. They may contain errors and should not be treated as personalised medical or dietary advice.
• If you are pregnant, breastfeeding, have an eating disorder, or have any other medical condition that affects nutrition, consult a healthcare provider before using NutriFell's tracking features.
• If you are experiencing a medical emergency, call your local emergency services immediately.

By using NutriFell, you acknowledge that you have read this disclaimer and agree that NutriFell is not responsible for any health outcomes resulting from information provided by the Service.

07 Payments & Subscriptions

NutriFell is currently in free beta. All features are available at no charge. The following terms will apply when paid plans are introduced.

• Payment processing: All payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.
• Billing: Subscriptions are billed monthly or annually as selected. Your subscription auto-renews at the end of each period unless cancelled.
• Cancellation: You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: We offer a 7-day refund window from the date of first payment or renewal. Contact support@nutrifell.com to request a refund.
• Price changes: We will notify subscribers by email at least 30 days before any price change. Continued subscription after the change date constitutes acceptance.
• Free beta: Features available during the free beta period may be moved behind a paid plan when billing launches. We will give at least 30 days notice.

08 Intellectual Property

NutriFell's IP: The NutriFell brand, logo, application code, nutritional database, 3D models, and all original content created by us are our exclusive property and are protected by copyright. You may not reproduce, distribute, or create derivative works without written permission.

Your IP: You retain full ownership of content you create and post, as described in Section 5.

Open-source components: NutriFell uses several open-source libraries (Three.js, Express, etc.) under their respective licences. Use of these components does not transfer any IP rights to you beyond what those licences provide.

09 Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

To the fullest extent permitted by law, NutriFell and its operator shall not be liable for:

• Any health outcomes — positive or negative — resulting from use of information provided by the Service
• Loss of data due to server failure, accidental deletion, or any other cause
• Indirect, incidental, consequential, or punitive damages of any kind
• Service interruptions, bugs, or errors in calculations
• Actions taken by third-party services (Stripe, Google Gemini, Hostinger)

Our total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €10, whichever is greater.

10 Termination

By you: You may delete your account at any time by contacting us at support@nutrifell.com. Account deletion removes your profile data and personal content. Some data (e.g. public posts, aggregate analytics) may be retained in anonymised form.

By us: We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, engage in abusive behaviour, or if we are required to do so by law. For less severe violations we will generally issue a warning first.

Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, and 9 survive termination.

11 Governing Law

These Terms are governed by the laws of Georgia (the country), without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Georgia, except where mandatory local consumer protection laws in your jurisdiction apply.

If you are an EU consumer, nothing in these Terms limits your rights under EU consumer protection law or GDPR.
